Turkish Constitutional Court finds Yüksekdağ’s detention ‘reasonable’

The Constitutional Court has replied to the application filed by the former co-chair of the Peoples’ Democratic Party (HDP), Figen Yüksekdağ on February 26, 2021.

 

The Constitutional Court said that Yüksekdağ’s rights to personal liberty and security were not “violated”.

The Court stated that the continuation of Yüksekdağ’s detention does not violate the rights of the politician who has been on trial since November 4, 2016.

The Constitutional Court cited an earlier ruling for the continuation of the detention in the Kobanê Trial held by the Ankara 22nd Heavy Penal Court.

The court concluded that the detention period of approximately 3 years and 1 month is reasonable since there is “strong evidence that a crime has been committed, which is a prerequisite for detention…and there is no carelessness in the conduct of the investigation/prosecution.”
